This article aims to shed light on the possible influence of the Kabbalah on Spinoza. To do this, I will analyze the role that the Kabbalist theoretical model may have had on the development of Spinozist philosophy, in order to understand both their convergences and their divergences. I will then clarify Spinoza's relationship to this theory, especially the Lurianic Kabbalah, and emphasize the importance of the notion of Tsimtsum (contraction of the Divine light).

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. OBJETIVO -/- O estudante de Zootecnia e de Veterinária, quando se depara com a produção animal, um dos pilares importantes é a reprodução, uma vez que é a perpetuação da espécie, seja para gerar filhas de uma vaca campeã em produção leiteira e de um touro com rusticidade e com aptidão produtiva de corte, ou mesmo para reposição de um plantel, o mesmo deve estar consciente de que esse ramo é de extrema responsabilidade, já que estará intimamente lidando com a (...) vida e com um investimento que pode gerar lucros em demasia para a propriedade ou, se mal feito o manejo da reprodução, trazer sérios transtornos para a mesma. -/- Nesse trabalho, o estudante revisará os sucessos da puberdade e estacionalidade reprodutiva relacionando-os com os processos endócrinos e os fatores que afetam sua manifestação como os nutricionais, para compreender a maneira ao qual podem ser manipuladas. -/- -/- • _____INTRODUÇÃO -/- A puberdade marca o início da vida reprodutiva do animal, permitindo integrar o indivíduo ao seu ciclo produtivo. A estacionalidade é uma característica de adaptação que algumas espécies desenvolveram para fazer garantir a eficiência da reprodução e a sobrevivência dos filhotes. -/- -/- • _____PUBERDADE -/- A puberdade é atingida quando o animal é capaz de produzir e liberar gametas viáveis e funcionais (férteis). Na fêmea esse fato ocorre na primeira ovulação, que geralmente coincide com a manifestação do comportamento do cio; e nos machos durante a primeira ejaculação com espermatozoides viáveis. -/- Do ponto de vista da produção animal, puberdade prematura ou precoce, é importante para poder permitir a incorporação dos animais ao ciclo produtivo o mais rapidamente possível. No caso de touros holandeses, por exemplo, é desejável que produzam sêmen precocemente para incorporá-los a prova de progênie; nas fêmeas, entretanto, deve-se considerar que nem sempre é conveniente usar o primeiro ciclo ou cio para reprodução. É o caso das marrãs (porcas primíparas), onde é benéfico esperar até o segundo ou terceiro estro para aumentar o tamanho da ninhada. Também pode ser vantajoso esperar que o indivíduo alcance sua maturidade sexual, que ocorre quando a fêmea consegue se reproduzir sem sofrer efeitos adversos. A ovelha nascida na primavera, por exemplo, pode engravidar no outono seguinte e dar à luz no primeiro ano de vida, mas seu crescimento pode ser afetado; o mesmo ocorre com a novilha, em que o acasalamento precoce pode promover distorcia por falta de desenvolvimento pélvico. -/- A puberdade é um processo gradual e está intimamente relacionada à taxa de crescimento e ao metabolismo energético. O recém-nascido usa energia para funções vitais, principalmente termorregulação; esse feito se deve ao fato de os jovens possuírem uma superfície corporal muito elevada em relação ao seu volume. Durante o desenvolvi-mento subsequente dos tecidos também há prioridade no uso de nutrientes, que inicialmente favorecem o desenvolvimento do tecido ósseo e muscular, e uma vez que estes atingem determinado tamanho de acordo com as condições genéticas do indivíduo, inicia-se o desenvolvimento do tecido adiposo, que é indicativa de um reservatório de energia. É importante ressaltar que existe uma interação entre a genética e o meio ambiente, de forma que o potencial genético só será expresso se o meio ambiente for favorável. -/- Para que a ovulação ocorra, é necessário considerar o funcionamento do eixo hipotálamo-hipófise-gonodal. O aumento da frequência pulsátil do GnRH hipotalâmico e em consequência do LH hipofisário provoca a maturação do folículo em nível gonodal, o que aumenta a produção de estrógenos. O aumento dos estrogênios causa, por feedback positivo no hipotálamo, a liberação do pico pré-ovulatório de LH e, consequentemente, a ovulação. Na fase pré-púbere, a frequência dos pulsos de GnRH e LH é muito baixa e insuficiente para provocar a maturação folicular, pois o hipotálamo é inibido e, portanto, não ocorre ovulação. -/- A geração pulsátil de GnRH no momento reprodutivo adequado para desencadear o início da puberdade depende de uma rede neural complexa que, além dos neurônios GnRH, inclui outros neurônios e células da glia; ele também integra vários sinais internos e externos para o corpo. A morfologia dos neurônios GnRH também é única, uma vez que seus dendritos também podem funcionar como axônios, dando-lhes uma função distinta. A geração de pulsos também indica a necessidade de sincronização entre subpopulações de neurônios GnRH, que, acima de tudo, parece ser extrínseca a esses neurônios e envolve múltiplos hormônios e neurotransmissores -/- Se dois níveis de conexões aferentes são considerados, estima-se que cada neurônio de GnRH pode ser conectado a cerca de cinco milhões de outros neurônios; milhares de genes, então, podem estar envolvidos no processo da puberdade. A importância funcional e hierárquica de cada um desses genes no controle dos neurônios GnRH, juntamente com outros fatores neuronais e gliais, pode diferir entre as espécies. Existem, no entanto, componentes fundamentais que parecem ser comuns a todos os mamíferos e que se situam nos níveis hierárquicos mais elevados, ajudando a compreender a progressão do processo puberal. Assim, todas as espécies de mamíferos estudadas, por exemplo, têm aglomerados de neurônios kisspeptinérgicos (que secretam kisspeptina), envolvidos na regulação da secreção tônica e secreção cíclica de GnRH, que também se classifica como o elemento mais alto na hierarquia desse complexo neuronal após considerar os neurônios GnRH. -/- Sabe-se que o eixo hipotálamo-hipofisário-gonodal está ativo desde as primeiras fases da vida do indivíduo, mesmo antes do nascimento em certas espécies. A secreção de GnRH, no entanto, é suprimida mais tarde no desenvolvimento e permanece dessa forma até o período pré-púbere, quando será reativada gradualmente. -/- Por várias décadas, a supressão e reinicialização dos pulsos de GnRH foi atribuída a uma hipótese conhecida como teoria gonadostat que afirma que o centro tônico do hipotálamo é inibido devido à sua sensibilidade ao mecanismo de feedback negativo dos esteroides gonodais, é aumentado; portanto, o GnRH e a consequente secreção de gonadotrofinas (FSH e LH) são insuficientes para a ocorrência da maturação folicular e espermatogênese. Essa sensibilidade diminui progressivamente à medida que a puberdade se aproxima. -/- Sabe-se agora que existem fatores não gonodais que agem em paralelo com os esteroides para mediar mudanças no feedback negativo que também são específicos da espécie. -/- Na fêmea, o centro gerador de pulso cíclico também deve ser considerado, o qual é responsável por iniciar a primeira ovulação. O centro cíclico é composto por uma segunda subpopulação de neurônios GnRH que é reativada por meio de uma complexa interação entre vários sistemas neuronais inibitórios (que devem reduzir progressiva-mente sua influência) e outros sistemas excitatórios, que, por sua vez, operam por meio de diferentes neurotransmissores, como o ácido γ-amino-butírico (GABA) e seus receptores, glutamato, óxido nítrico e neuropeptídio Y (NPY). Esses fatores, juntamente com as alterações morfológicas observadas nos neurônios do GnRH à medida que a puberdade se aproxima, e com as interações e sinais aferentes das células gliais, levam a um padrão de progressão linear que culminará na reativação do centro cíclico. Esse processo era conhecido anteriormente como teoria da maturação central e faz parte das mudanças que configuram o processo para chegar à puberdade. A elevação nas concen-trações de estradiol subsequente à reativação gradual do centro gerador de pulso tônico GnRH provavelmente permitirá a maturação final do centro cíclico. -/- A forma como cada organismo estabelece o momento certo para iniciar as mudanças que levam à puberdade é conhecido; a existência de algum mecanismo neurobiológico que constitui um relógio interno pode ser considerada. No entanto, esse mecanismo afetaria principalmente o desenvolvimento neuronal no nível central; também seria difícil compará-lo com a maneira pela qual fatores externos ao indivíduo afetam o início da puberdade. Nessa perspectiva, um sistema que permita receber informações completas sobre o crescimento e desenvolvimento do indivíduo poderia ser mais prático. Os mediadores desse sistema incluem o hormônio do crescimento, IGF-I, leptina e outros substratos metabólicos. A leptina em particular, que sinaliza as reservas de tecido adiposo, é um dos elementos mais importantes e, embora não determine quando começa a puberdade, se atua como fator permissivo para que o processo progrida, uma vez que excede um nível limite. A consideração do estágio de desenvolvimento do animal para o início da puberdade era anteriormente conhecida como o peso corporal crítico ou teoria do lipostato. É importante considerar que as três teorias mencionadas não são exclusivas. -/- O mecanismo da puberdade nos machos é semelhante ao já descrito; entretanto, deve-se lembrar que no macho o centro cíclico não está ativo. À medida que a puberdade se aproxima, o crescimento testicular é desencadeado e, em ruminantes e suínos, o pênis que estava preso à mucosa prepucial é gradualmente liberado. -/- -/- • _____FATORES QUE INFLUENCIAM A PUBERDADE -/- Os animais podem manifestar a puberdade de três formas diferentes. Pode ser tardia e o animal demorar para estar apto a reprodução; precoce e o animal entrar na vida reprodutiva antes do esperado ou pode ser normal e o animal estar com boa conformação e idade. Para tanto, alguns fatores podem interferir à manifestação da puberdade pelos animais como a genética, idade e peso, nutrição, fotoperíodo e o próprio manejo adotado. -/- -/- Genética -/- O genótipo afeta a idade da puberdade, pois algumas raças são anteriores a outras. Nos bovinos, as raças europeias atingem a puberdade antes dos zebuínos, isto é, uma novilha ou novilho da raça holandesa atinge a puberdade primeiro que os animais da mesma idade e do mesmo peso da raça nelore, por exemplo. -/- Da mesma forma, as porcas da raça chinesa Meishan atingem a puberdade por volta dos 115 dias de idade, metade da idade das raças brancas. As ovelhas de raças de corte, da mesma forma, são mais precoces que os produtores de lã. As raças pequenas, da mesma forma, são geralmente mais precoces, pelo menos em bovinos (jersey x guzerá) e em caninos. Os híbridos, por outro lado, apresentam puberdade mais precoce que os puros, devido ao efeito da heterose. Por este motivo, em certas espécies são utilizadas linhas híbridas. -/- -/- Idade e peso -/- A tabela 1 mostra a idade média de início da puberdade em espécies domésticas. O peso vivo (PV) adulto é mais relevante para a idade na puberdade nos ruminantes, enquanto em suínos é menos decisivo. A superalimentação também não é recomendada, pois pode alterar tanto os sinais que são recebidos pelo hipotálamo quanto sua resposta a eles. -/- Logo, o manejo alimentar adotado deve estar de acordo com as normas estabeleci-das pelos especialistas na área, principalmente no tocante as exigências nutricionais que devem servir de regra na propriedade. Sendo assim, os animais entrarão em puberdade com as taxas de alta qualidade o que afetará positivamente na prole futura e dará retorno lucrativo ao proprietário. -/- -/- Época do ano (Fotoperíodo) -/- Em fêmeas de espécies sazonais, como ovelhas e cabras, existem certos requisitos de fotoperíodo que devem ser atendidos para que a puberdade ocorra. Nessas espécies, um período de exposição a dias longos é necessário, seguido por outro de exposição a dias curtos. Na verdade, os cordeiros e cabritos nascidos fora da estação, mesmo que tenham atingido o peso necessário, terão que esperar até o outono seguinte (a estação reprodutiva) para atingir a puberdade. Os machos, por outro lado, não estão sujeitos a essas limitações nos requisitos fotoperiódicos para apresentar a puberdade. -/- Em novilhas nascidas no outono, por outro lado, a puberdade ocorre antes de um ano de idade, no verão seguinte ou no início do outono, mais cedo do que nas nascidas na primavera, devido à exposição a longos dias durante os primeiros seis meses do ano após seu nascimento aceleram seu crescimento. Em gatos, o aumento do fotoperíodo também acelera o início da puberdade. -/- Em ovelhas e novilhas, a primeira ovulação que ocorre ao entrar na puberdade é silenciosa; ou seja, não é acompanhada de sinais comportamentais de cio como a micção frequente, inchamento da vulva, uma montando a outra e deixando-se montar etc., pois para que esse comportamento se manifeste, o sistema nervoso necessita de uma pré-sensibilização com progesterona que não estará presente até o próximo ciclo, após o desenvolvimento do corpo lúteo vindo desta primeira ovulação. -/- -/- Sociossexual -/- A interação de indivíduos da mesma espécie ou a presença ou ausência de sinais de bioestimulação, como feromônios, pode afetar o período de puberdade. A puberdade, por exemplo, é atrasada em porcas criadas individualmente em comparação com porcas criadas em grupo. Além disso, na porca, ovelha e cabra, a exposição ao macho estimula as fêmeas e a puberdade aparece mais precocemente. -/- -/- Manejo -/- Certas práticas de manejo podem acelerar a puberdade, especialmente no período pré-púbere. Em porcas próximas à puberdade, por exemplo, o estresse causado por procedimentos, como o transporte de um local para outro ou a exposição ao macho, faz com que apareça o estro em torno de sete dias após a realização do manejo mencionado. -/- -/- • _____ESTACIONALIDADE REPRODUTIVA -/- A estacionalidade ou sazonalidade reprodutiva é uma estratégia evolutiva que se desenvolveu em algumas espécies; tende a tornar a reprodução mais eficiente. Nos países de latitudes distantes do equador, o objetivo é que as crias nasçam na primavera, época do ano mais favorável, graças à abundância de alimentos e às amenas condições climáticas. No caso da ovelha, cuja gestação dura cinco meses, para que os partos ocorram na primavera, ela deve engravidar no outono (figura 1), quando os dias são curtos; enquanto a égua, tendo uma gestação de aproximadamente 11 meses, deve conceber na primavera, quando os dias são longos; assim, o parto ocorrerá na primavera do ano seguinte (figura 2). -/- -/- Figura 1: Esquema ilustrativo da estacionalidade reprodutiva na espécie ovina. Fonte: PIRES et al., 2011. -/- -/- Esta característica evolutiva desenvolvida pela seleção natural na maioria das espécies silvestres e ainda é conservado por algumas espécies domésticas, como ovelhas, cabras, cavalos e gatos. Em bovinos e suínos, ao contrário, a domesticação levou à perda quase total da estacionalidade reprodutiva. -/- A estacionalidade reprodutiva é codificada nos genes; significa então que a seleção natural favoreceu a propagação de genes que permitiam acoplar a hora do nascimento com a melhor época do ano, por isso passou a ser considerada um método anticoncepcional natural. -/- -/- Figura 2: ciclo reprodutivo anual em espécies estacionais; onde são apresentados os períodos de gestação e a forma como se agrupam os nascimentos, independentemente da época reprodutiva da espécie, em vermelho as fêmeas estão apresentando estro ou cio. Fonte: VALENCIA, 2018. -/- -/- Fotoperíodo -/- Para sincronizar o período fértil com a época mais favorável do ano, a maioria das espécies sazonais usa o fotoperíodo (quantidade de luz diária ao longo do ano). -/- Este sinal ambiental é seguro, confiável e se repete a cada ano. Ovinos e caprinos se reproduzem na época do ano em que os dias são curtos e os equinos quando são longos. O grau de sazonalidade depende da origem da raça. As raças nativas de países localizados em latitudes elevadas (> 50°,ovelhas: soay, blackface, suffolk; cabras: saanen, alpino francês, toggenburg; equinos: puro-sangue, hanoveriano) terão uma estacionalidade mais acentuada do que as latitudes menores ou mediterrâneas (ovelhas: merino; cabras: murciana granadina; equinos: quarto de milha). Também existem raças de latitudes próximas ao Equador cuja estacionalidade é baixa ou nula (ovelhas: raças de pelo, crioulas; cabras: raças africanas e asiáticas) (tabela 2). -/- Para a maioria das raças de ovinos e caprinos, a estação reprodutiva começa no final do verão e início do outono; caracteriza-se pela apresentação de ciclos estrais sucessivos, e termina no final do inverno, quando se inicia o anestro, que se caracteriza pela ausência de ovulação. Consequentemente, a pulsatilidade do LH também diminui, que agora é incapaz de induzir a maturação folicular, o aumento dos estrogênios, o pico pré-ovulatório de LH e, portanto, a ovulação. -/- Isso ocorre porque durante o anestro a sensibilidade do hipotálamo ao mecanismo de feedback negativo dos estrogênios e de outros fatores de origem não gonodal é aumentada. Ao aproximar-se da estação reprodutiva, a sensibilidade hipotalâmica diminui e o aumento da pulsatilidade do GnRH causa as mudanças que culminam na ovulação. Portanto, o mecanismo endócrino do anestro estacional é semelhante ao do anestro pré-púbere e de alguns outros tipos de anestro. -/- A estacionalidade é um bom exemplo da interação entre o meio ambiente e o sistema neuroendócrino, pois o organismo é capaz de traduzir um sinal externo ambiental, como o fotoperíodo, em um sinal hormonal interno, que neste caso é a melatonina. -/- A glândula pineal secreta melatonina durante as horas de escuridão. Os animais sazonais apresentam um ritmo reprodutivo endógeno, que é regulado por janelas de fotossensibilidade, determinadas por mudanças na duração do dia. O sinal luminoso é captado pela retina e conduzido, via nervo, pelo trato retino-hipotalâmico até o núcleo supraquiasmático, que funciona como o relógio biológico do corpo. Daí o sinal viaja para o núcleo para-ventricular, depois para o gânglio cervical e, finalmente, para a glândula pineal, que responde secretando melatonina (figura 3). -/- Nas ovelhas, a estação reprodutiva começa quando a duração do dia diminui e, naturalmente, a noite aumenta; na égua, ocorre quando os dias se alongam. -/- A primavera não é necessariamente a melhor época do ano em todas as regiões do globo. Nas latitudes tropicais, a primavera coincide com a seca e não com a abundância de forragem, aspecto a ser levado em consideração ao programar a reprodução. -/- Outro ponto importante a considerar é que as raças europeias sazonais mantêm sua estacionalidade no Brasil. -/- -/- Figura 3: Mecanismo do fotoperíodo em ovinos e a melatonina. Fonte: HAFEZ, 2004. -/- -/- Estacionalidade no macho -/- O macho é menos afetado que a fêmea pelas mudanças típicas de cada época do ano, já que sua função reprodutiva não é necessariamente interrompida durante o anestro ou repouso sexual, embora a produção de hormônios reprodutivos, tamanho e tônus testicular, a libido, as características qualitativas e quantitativas do ejaculado e a fertilidade do esperma podem ser diminuídas. O nível de afetação depende do grau de sazonalidade da raça e da latitude. Many manipulation arguments against compatibilism rely on the claim that manipulation is relevantly similar to determinism. But we argue that manipulation is nothing like determinism in one relevant respect. Determinism is a "universal" phenomenon: its scope includes every feature of the universe. But manipulation arguments feature cases where an agent is the only manipulated individual in her universe. Call manipulation whose scope includes at least one but not all agents "existential manipulation." Our responsibility practices are impacted in different ways by (...) universal and existential phenomena. And this is a relevant difference, especially on Strawsonian approaches to moral responsibility, which take facts about our responsibility practices to be deeply connected to the nature of responsibility itself. We argue that Strawsonian accounts of moral responsibility are immune to manipulation arguments, and no attempt to modify the scope of manipulation or determinism featured in these arguments will help incompatibilists secure their desired conclusion. In this paper, I examine the role of attention in Kant’s aesthetic theory in the Critique of the Power of Judgment. While broadly Kantian aestheticians have defended the claim that there is a distinct way that we attend to objects in aesthetic experience, Kant himself is not usually acknowledged as offering an account of aesthetic attention. On the basis of Kant’s more general account of attention in other texts and his remarks on attention in the Critique of the Power of (...) Judgment, I reconstruct Kant’s account of aesthetic attention. On this account, aesthetic attention is simultaneously directed at the form of an object and at the judging subject’s own mental states as she attends to the object. In the experience of beauty, we specifically attend to the harmonious relation between the faculties of imagination and understanding. (shrink)

There are two versions of the language-of-thought hypothesis (LOT): Representational LOT (roughly, structured representation), introduced by Ockham, and computational LOT (roughly, symbolic computation) introduced by Fodor. Like many others, I oppose the latter but not the former. Quilty-Dunn et al. defend representational LOT, but they do not defend the strong computational LOT thesis central to the classical-connectionist debate.

Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. If the world itself is metaphysically indeterminate in a specified respect, what follows? In this paper, we develop a theory of metaphysical indeterminacy answering this question.

A key question in the philosophy of logic is how we have epistemic justification for claims about logical entailment (assuming we have such justification at all). Justification holism asserts that claims of logical entailment can only be justified in the context of an entire logical theory, e.g., classical, intuitionistic, paraconsistent, paracomplete etc. According to holism, claims of logical entailment cannot be atomistically justified as isolated statements, independently of theory choice. At present there is a developing interest in—and endorsement of—justification holism (...) due to the revival of an abductivist approach to the epistemology of logic. This paper presents an argument against holism by establishing a foundational entailment-sentence of deduction which is justified independently of theory choice and outside the context of a whole logical theory. This paper shows that Hume was ultimately forced to conclude in The Treatise that all demonstrative and intuited claims can in fact, be imagined as otherwise. As a result, he was forced to conclude that all knowledge claims must, ultimately, reduce to probable claims, or in Hume’s own, and indisputably clear words: “all knowledge degenerates into probability." As a further result, it is suggested (briefly) that this anticipates Quine’s well-known attack on the analytic / synthetic distinction (Quine 1953).

There has been a call for a potentially revolutionary change to our existing understanding of the psychological concept of personal identity. Apparently, people can psychologically represent people, including themselves, as multiple individuals at the same time. Here we ask whether the intransitive judgments found in these studies truly reflect the operation of an intransitive concept of personal identity. We manipulate several factors that arbitrate between transitivity and intransitivity and find most support for transitivity: in contrast to prior work, most participants (...) do not make intransitive judgments when there is any reason to favor one individual over another. People change which single individual they personally identify with, depending on which individual competes more strongly or weakly for identity, rather than identifying with both individuals. Even when two individuals are identical and therefore both entitled to be the same person, we find that people make more transitive judgments once they understand the practical commitments of their responses (Experiment 4), and report not being able to actually imagine two perspectives simultaneously when reasoning about the scenario (Experiment 5). In short, we suggest that while people may make intransitive judgments, these do not reflect that they psychologically represent identity in an intransitive manner. (shrink)

The view that it is better for life to be created free of disability is pervasive in both common sense and philosophy. We cast doubt on this view by focusing on an influential line of thinking that manifests it. That thinking begins with a widely-discussed principle, Procreative Beneficence, and draws conclusions about parental choice and disability. After reconstructing two versions of this argument, we critique the first by exploring the relationship between different understandings of well-being and disability, and the second (...) by more briefly focusing on the idea of a significant reason. By placing these results against the broader historical and ongoing contexts in which the lives of those with disabilities have been deemed of inferior quality, we conclude with a call for greater humility about disability and well-being in thought and practice. This paper concerns a distinction between circumstantial truths that hold because of the circumstances and acircumstantial truths that hold regardless of, or transcend, the circumstances. Previous discussions of the distinction tended to focus on its applications, such as to modality, logical truth, and essence. This paper focuses on developing the distinction largely, but not entirely, in abstraction from its potential applications. Moral perceptualism is the theory that perception and perceptual experience is attuned to moral features in our environment. This idea has received renewed attention in the last 15–20 years, for its potential to do theoretical work in moral epistemology and moral psychology. The leading models of disability struggle to fully encompass all aspects of “disability.” This difficulty arises, the author argues, because the models fundamentally misunderstand the nature of disability. Current theoretical approaches to disability can be understood as “nounal,” in that they understand disability as a thing that is caused or embodied. In contrast, this paper presents an adverbial perspective on disability, which shows that disability is experienced as a personally irremediable impediment to daily-living tasks or goals-like-ours. The picture theory of (...) disability technically constitutes a species of relational approach because its analysis references the interplay between an individual and their environment; it differs from other relational accounts, however, by interpreting disability as a certain kind of negative experience—rather than a function of that relationship. This purely descriptive theory makes no normative claims about disability and operates as both a mechanism for the evaluation of the experience of disability and a heuristic device for the proper interpretation of disability. When disability is reframed in this way, the theory offers a particularist perspective which shows if, when, where, and how disability is experienced. (shrink)

This analysis summarizes conclusions on an evolutionary model for the origin of moral and religious capacities in the genus Homo. The authors’ published model (2020, Routledge) is now extended to the emergence of nascent theological thinking, augmenting the previous line of theory based on genomics, cognitive science, neuroscience, paleoneurology, cognitive archaeology, ethnography, and modern social science. This analysis concludes that findings support the earliest theological thinking in Homo sapiens, but not in an earlier species, Homo erectus, and clarifies why and (...) when it likely began. Types of anatomy, behavior, neurology, and cognition are presented that support tendencies to frame a structure of religious principles and a set of supernatural figures that early humans would consider right, just, exemplary, and even sacred. Stages of emergent physical, behavioral, and cognitive features are presented in tables. Moral perception has made something of a comeback in recent work on moral epistemology. Many traditional objections to the view have been argued to fail upon closer inspection. But it remains an open question just how far moral perception might extend. In this paper, I provide the beginnings of an answer to this question by assessing the relationship between the metaphysical structure of different normative properties and a plausible constraint on which properties are eligible for perceptual awareness which I call (...) the Counterfactual Strengthening Test. Along the way I consider and reject a few other possible constraints on perceptual awareness. I defend the view that moral perception is restricted to the perception of evaluative and pro tanto deontic properties. I conclude with a few gestures toward what this limitation on moral perception may mean for broader moral epistemology. (shrink)

Este artigo investiga a possibilidade de questões morais possuírem a mesma natureza de ocorrências no mais das vezes (ὡς ἐπὶ τὸ πολύ) discutidas na Física, Metafísica e nos Analíticos, em contraste com as categorias de necessário sem mais e de acaso/acidente. Tal categoria (ὡς ἐπὶ τὸ πολύ) ora é aproximada daquilo que é necessário (necessidade sem mais), quando Aristóteles realça a exclusão do acaso/acidente da ciência, ora é afastada do necessário sem mais, quando busca especificar as diferenças entre essas categorias (...) em termos das conclusões passíveis de serem obtidas em silogismos de ambos os tipos. O que parece é que as ações decorrentes de um caráter formado são ὡς ἐπὶ τὸ πολύ, podendo ser compreendidas no registro de um necessário hipotético, dado que o caráter é como uma “segunda natureza” do agente. Se tal hipótese for correta, ações decorrentes de um caráter formado não possuiriam estatuto de abertura aos contrários. (shrink)

Deflationists about truth hold that the function of the truth predicate is to enable us to make certain assertions we could not otherwise make. Pragmatists claim that the utility of negation lies in its role in registering incompatibility. The pragmatist insight about negation has been successfully incorporated into bilateral theories of content, which take the meaning of negation to be inferentially explained in terms of the speech act of rejection. We implement the deflationist insight in a bilateral theory by taking (...) the meaning of the truth predicate to be explained by its inferential relation to assertion. We combine this account of the meaning of the truth predicate with a new diagnosis of the Liar Paradox: its derivation requires the truth rules to preserve evidence, but these rules only preserve commitment. The result is a novel inferential deflationist theory of truth, which solves the Liar Paradox in a principled manner. We end by showing that our theory and simple extensions thereof have the resources to axiomatize the internal logic of several supervaluational hierarchies, including Cantini’s. This solves open problems of Halbach (2011) and Horsten (2011). (shrink)

Academic excellence and intelligence are commonly lauded as commendable attributes synonymous with success. However, a disconcerting trend has surfaced within educational institutions, challenging the prevailing narrative of scholastic accomplishment—smart shaming. This research delves into the increasing concern of smart shaming within educational settings, particularly at Immaculate Conception College of Balayan, Inc., questioning the predominant emphasis on academic excellence and intelligence. A qualitative case study design, along with judgmental sampling, was employed to examine fifteen (15) student leaders who had experienced smart (...) shaming on campus. Thematic analysis revealed that sarcastic remarks including "edi wow," "Okay ikaw na matalino," "bidabida," and "sipsip" were a prevalent manifestation of smart shaming, adversely affecting emotional well-being, academic and leadership prowess, mental health, and self-perception. Coping mechanisms, predominantly centered around ignoring and focusing on goals, were identified. The findings underscore the imperative for educators to remain vigilant regarding instances of smart shaming in classrooms, promoting open communication to ensure student well-being. Additionally, guidance counselors play a pivotal role in aiding students in effectively navigating the repercussions of smart shaming. This study advocates for proactive programs and interventions to address and alleviate the deleterious effects of smart shaming on students. (shrink)

In this paper, I propose a novel interpretation of the role of the understanding in generating the unity of space and time. On the account I propose, we must distinguish between the unity that belongs to determinate spaces and times – which is a result of category-guided synthesis and which is Kant’s primary focus in §26 of the B-Deduction, including the famous B160–1n – and the unity that belongs to space and time themselves as all-encompassing structures. Non-conceptualist readers of Kant (...) have argued that this latter unity cannot be the product of categorial synthesis. While they are correct that this unity is not the product of any particular act of category-guided synthesis, I argue that conceptualists are right to nevertheless attribute this unity to the understanding. I argue that it is a result of what we can think of as the ‘original’ synthesis of understanding and sensibility themselves – it is a synthesis, moreover, in which the whole is logically prior to the parts. Can groups really be agents or is group agency just a fiction? Christian List and Philip Pettit argue influentially for group-agent realism by showing how certain groups form and act on attitudes in ways they take to be unexplainable at the level of the individual agents constituting them. Group agency is therefore considered not a fiction or a metaphor but a reality we must account for in explanations of certain social phenomena. In this paper, I challenge this defence of group-agent (...) realism by showing how it is undermined by individual-level analysis of how individuals interact within groups. While group agency can be a useful fiction, real agents are at the individual level, not the collective level. (shrink)

El artículo aborda el problema de la relación entre el ser humano y la técnica en el mundo actual desde una perspectiva filosófica. Volver a la concepción de la filosofía griega permite concebir hoy el quehacer filosófico como un ejercicio vital, sin fracturas entre el pensamiento y la acción. La patente plasticidad del ser humano evidencia la constitutiva apertura que determina su especificidad y, además, columbra la estrecha vinculación entre técnica, creación y cuidado a partir del acontecimiento del habitar. El (...) cuidado no puede tener lugar sin cierta promoción de un ethos cultural centrado en el miramiento, la asistencia y la preocupación por uno mismo y por el Otro. El olvido de la relación entre la creación y el cuidado conduce a un desequilibrio ethopoiético entre la condición ontológica del ser humano, como ser nacido, finito y vulnerable, y el desarrollo tecnológico, impulsado por la digitalización de la vida y el ascendente papel de las nuevas tecnologías en la sociedad. Advertir y remediar dicho desequilibrio supone repensar la originaria relación entre la creación técnica y el cuidado ético, así como la importancia de la ética para la persistencia de lo orgánico. This book provides the first comprehensive account of Hume’s conception of objects in Book I of the Treatise. What, according to Hume, are objects? Ideas? Impressions? Mind-independent objects? All three? None of the above? Through a close textual analysis, I show that Hume thought that objects are imagined ideas. However, I argue that he struggled with two accounts of how and when we imagine such ideas. On the one hand, Hume believed that we always and universally imagine that objects are (...) the causes of our perceptions. On the other hand, he thought that we only imagine such causes when we reach a “philosophical” level of thought. This tension manifests itself in Hume’s account of personal identity; a tension that, I argue, Hume acknowledges in the Appendix to the Treatise. As a result of presenting a detailed account of Hume’s conception of objects, we are forced to accommodate new interpretations of, at least, Hume’s notions of belief, personal identity, justification and causality. The norm of assertion, to be in force, is a social norm. What is the content of our social norm of assertion? Various linguistic arguments purport to show that to assert is to represent oneself as knowing. But to represent oneself as knowing does not entail that assertion is governed by a knowledge norm. At best these linguistic arguments provide indirect support for a knowledge norm. Furthermore, there are alternative, non-normative explanations for the linguistic data (as in recent work from (...) Van Elswyk). Direct arguments would rely on normative judgments about the permissibility or impermissibility of assertions with and without the speaker knowing the content asserted. John Turri's work experimental results purport to show that our norm of assertion is factive, and probably knowledge. But as a number of recent experimentalists (Kneer, Reuter and Broessel, Marsili and Wiegmann) have shown, Turri's results rely on the problemmatic use of 'should' as in 'Maria should assert that she owns a 1990 watch.' Correcting for this, these experimentalists provide strong evidence that our norm of assertion is not factive. The standard reply to evidence like this from the assertion of unlucky falsehoods is the excuse maneuver. But Marsili and Wiegmann, following Turri's protocol for testing for excuse validation, show that participants who judge that assertions unlucky falsehoods are permissible are not guilty of excuse validation. Given our current understanding of the experimental evidence, knowledge is not our norm of assertion. (shrink)

Some skeptical theists use Wykstra’s CORNEA constraint to undercut Rowe-style inductive arguments from evil. Many critics of skeptical theism accept CORNEA, but argue that Rowe-style arguments meet its constraint. But Justin McBrayer argues that CORNEA is itself mistaken. It is, he claims, akin to “sensitivity” or “truth-tracking” constraints like those of Robert Nozick; but counterexamples show that inductive evidence is often insensitive. We here defend CORNEA against McBrayer’s chief counterexample. We first clarify CORNEA, distinguishing it from a deeper underlying principle (...) that we dub “CORE.” We then give both principles a probabilistic construal, and show how, on this construal, the counterexample fails. What is it to base a belief on reasons? Existing attempts to give an account of the basing relation encounter a dilemma: either one appeals to some kind of neutral process that does not adequately reflect the way basing is a content‐sensitive first‐personal activity, or one appeals to linking or bridge principles that over‐intellectualize and threaten regress. We explain why this dilemma arises, and diagnose the commitments that are key obstacles to providing a satisfactory account. We explain why they should (...) be rejected anyway, and then offer a new, knowledge‐first virtue epistemological theory of the basing relation that shows how we can substantially theorize about mental processes without these commitments. The resulting view plausibly captures the way in which basing is an inherently mental and content‐sensitive process. (shrink)

In recent years, documentary formats have entered prominently into the realm of the culture industry, especially since Hollywood and Netflix started to invest in costly productions addressed to the mainstream. Many of these documentaries claim to show reality in its immediacy (“as it really is”), to reveal that which is obscured, or to critically assess societal evils. They use aesthetic strategies that reinforce the appearance of authenticity, while concealing the mediation of what they represent, and the authoritarian stances they presuppose. (...) This turns them into powerful instruments for diffusing authoritarian and populist ideologies. Their political impact on society, their performative power of opinion-shaping, and their subliminal influence on how we perceive and understand reality call urgently for critical assessment. Horkheimer and Adorno’s critique of the culture industry, along with their philosophical, sociological, and aesthetic writings, provide a constructive starting point. This essay aims to mobilize their critical theory of society for the problematization of documentary films in terms of their dialectical relation to society. (shrink)

Chung Kuo, Cina, a documentary film by Michelangelo Antonioni, aroused fierce criticism both in China and in Europe when it was released in 1973. While these objections contradicted one another, they all share a conceptual core : the notion of realism understood in a Marxian sense as a critical representation of reality. Yet by refusing to grant a coherent and essentialist meaning to its images, Chung Kuo, Cina problematizes the presuppositions of such an understanding of realism. In this way, the (...) film anticipates some of its intrinsic difficulties and inaugurates a new form of criticism. -/- À sa sortie en 1973, le film documentaire Chung Kuo, Cina de Michelangelo Antonioni a provoqué des critiques farouches aussi bien en Chine qu’en Europe. Bien qu’elles se contredisent entre elles, ces objections se rejoignent toutes dans un noyau conceptuel autour de la notion de réalisme, entendu au sens marxiste comme représentation critique de la réalité. Cependant, en refusant d’accorder un sens cohérent et essentialiste à ses images, ce film permet de problématiser les présupposés de cette compréhension même du réalisme. What we call “the evidential argument from evil” is not one argument but a family of them, originating (perhaps) in the 1979 formulation of William Rowe. Wykstra’s early versions of skeptical theism emerged in response to Rowe’s evidential arguments. But what sufficed as a response to Rowe may not suffice against later more sophisticated versions of the problem of evil—in particular, those along the lines pioneered by Paul Draper. Our chief aim here is to make an earlier version of skeptical (...) theism more responsive to the type abductive atheology pioneered by Draper. In particular, we suggest a moderate form of skeptical theism may be able to resist Draper’s abductive atheology. (shrink)

This paper brings together several strands of thought from both the analytic and phenomenological traditions in order to critically examine accounts of cognitive enhancement that rely on the idea of cognitive extension. First, I explain the idea of cognitive extension, the metaphysics of mind on which it depends, and how it has figured in recent discussions of cognitive enhancement. Then, I develop ideas from Husserl that emphasize the agential character of thought and the distinctive way that conscious thoughts are related (...) to one another. I argue that these considerations are necessary for understanding why forms of cognitive extension may diminish our cognitive lives in different ways. This does not lead to a categorical rejection of cognitive enhancement as unethical or bad for human flourishing, but does warrant a conservative approach to the design and implementation of cognitive artifacts. The Atlas Group appeals to philosophical thinking in multiple ways—both through its aesthetic figuration and its conceptual references. Presented as a foundation dedicated to the research and the compilation of documents on Lebanese contemporary history and organized in the form of an invented archive, this artistic project deliberately coalesces real and fictitious elements and confronts, subversively, Western views on the socio- political reality of the Middle East with implicit knowledge and experiences from the region. The singular constitution of this curious (...) archive subtly undermines the rational classification to which it alludes, thereby frustrating unilateral appropriations. Moreover, the question of the mediation of subjective experience and factual reality is consistently raised through the hysterical documents. This article aims to deploy how Walid Raad's project subtly criticises objectivist hegemonic claims by confronting divergent, often incommensurate approaches to the conflictual reality in Lebanon and its appropriation by media, historiography and politics. This paper presents an account of empathy as the form of experience directed at embodied unities of expressive movement. After outlining the key differences between simulation theory and the phenomenological approach to empathy, the paper argues that while the phenomenological approach is closer to respecting a necessary constitutional asymmetry between first-personal and second-personal senses of embodiment, it still presupposes a general concept of embodiment that ends up being problematic. A different account is proposed that is neutral on the explanatory role (...) of the first-person sense of embodiment, which leads to an emphasis on the transformative nature of empathy and a broadening of the scope of possible targets of empathic awareness. Este artículo se propone analizar la reinterpretación del concepto kantiano de crítica como una actitud ética en la obra de Foucault, destacando su relevancia para la hermenéutica crítica contemporánea. Por un lado, se explora cómo la práctica del cuidado de sí se convierte en un medio para “controlar” y “limitar” el poder, permitiendo así el ejercicio constante de la libertad. Esta concepción ética implica una nueva comprensión de la libertad, no como contrapuesta al poder, sino como su antecedente. La reflexión (...) crítica sobre la libertad, la ética y la verdad ofrece la posibilidad de transformarse continuamente a través del trabajo incesante en la construcción y el cultivo de uno mismo. Por otro lado, se presenta un método filosófico crítico basado en la autorreflexión, una ética hermenéutica del cuidado de sí, que abre nuevos horizontes interpretativos para dar forma al yo. Explorar la posibilidad de una nueva micropolítica crítica del signo a partir de Foucault, inspirada en la genealogía nietzscheana, y examinar las políticas y estrategias de alfabetización mediática e informacional necesarias para desarrollar competencias digitales en la transformación del ecosistema mediático es una tarea fundamental del quehacer filosófico actual. La pregunta por la posibilidad de la verdad retorna en un contexto en el que el pluralismo semiótico y la conducción mediática son dos elementos que rigen y ordenan la sociedad actual, (...) sociedad que se caracteriza por la abundancia de información y la omnipresencia de los medios de comunicación como tecnologías de poder. Desgranar su significado y vínculo nos conduce directamente al estudio del poder y el signo en relación con los efectos de la verdad de la posverdad. En este marco conceptual, la obra de Foucault proporciona herramientas teóricas valiosas para afrontar esta problemática. (shrink)

La sociedad del siglo XXI ha sufrido una mutación histórica en lo que respecta a los métodos de producción y los impactos derivados de la generación de información. Este período se caracteriza por su inmersión en el entorno digital, donde los individuos, como ciudadanos, se encuentran bajo la manipulación, por un lado, de sus datos mediante técnicas de vigilancia y, por otros, expuestos a cámaras de resonancia mediática. Este panorama plantea desafíos significativos en cuanto a la manera en que interactúan (...) con la información y cómo esta afecta sus vidas. La relación entre los medios de comunicación y los acontecimientos, además, se encuentra atravesada por el concepto de interpretación, donde la capacidad de comprender y la habilidad para reconstruir narrativas son elementos que determinan la comprensión y el sentido de lo que ocurre en nuestro mundo. “Hay momentos en la vida en los que la cuestión de saber si se puede pensar distinto de como se piensa o percibir distinto de como se ve es indispensable para seguir contemplando o reflexionando” (Foucault, 2003, p. 8). Esta declaración foucaultiana es la que impulsa la voluntad genealógica que presenta este ensayo, así como su pretensión proyectiva para pensar hoy la educación. El momento filosófico crítico consiste en volver sobre las prácticas que día a día llevamos a cabo y (...) configuran nuestras vidas y nuestras instituciones. Este es necesario para realimentar y reorientar la savia de las instituciones, y especialmente la savia de nuestras instituciones académicas, suelo en el cual se teje la sustancia ética que posteriormente dará lugar a la articulación social. Si se aplica el elemento crítico que la actividad filosófica supone a la experiencia de la educación, entendiendo por ella la correlación dentro de una cultura entre campos de saber, tipos de normatividad y formas de subjetividad, podemos preguntarnos: qué es la educación y qué función desempeña hoy con respecto al ejercicio mismo del pensamiento en un contexto atravesado por las nuevas tecnologías y la IA. Quien enseña sin emancipar no solo embrutece, predicaba Joseph Jacotot, sino que también adoctrina. Pasado un siglo y medio desde entonces, el filósofo y esteta francés emérito de la Universidad de París VIII y European Graduate School Jacques Rancière, en un ejercicio característico de la filosofía de la educación, publica en 1987 El maestro ignorante a partir de la experiencia de Jacotot. A lo largo de su vida y producción literaria, Rancière reflexiona concienzudamente sobre la naturaleza del proceso de enseñanza (...) y aprendizaje humano y se pregunta: ¿es posible enseñar? ¿qué decide el alumnado en su proceso de aprendizaje? ¿Cuáles son los límites de la palabra transmitida en el aprendizaje? ¿Es la determinación del saber un ejercicio del poder? ¿Son todos los seres humanos capaces de comprender lo que otros hacen y saben? ¿Qué relación hay entre el poder del maestro y el poder de la palabra? In this paper, we see that contrary to most readings of T 1.4.2 in the Treatise ("Of Skepticism with Regard to the Senses"), Hume does not think that objects are sense impressions. This means that Hume's position on objects (whatever that may be) is not to be conflated with the vulgar perspective. Moreover, the vulgar perspective undergoes a marked transition in T 1.4.2, evolving from what we may call vulgar perspective I into vulgar perspective II. In this paper, I argue that although Kant’s account of empirical schemata in the Critique of Pure Reason is primarily used to explain the shared content of intuitions and empirical concepts, it is also informed by methodological problems in natural history. I argue that empirical schemata, which are rules for determining the spatiotemporal form of objects, not only serve to connect individual intuitions with concepts, but also concern the very features of objects on the basis of which they were connected (...) and ordered in taxonomic systems based on similarity of form. I then suggest that Kant likely had scientific illustrations in mind in his discussion of empirical images in the Schematism chapter and that his account of schemata can help explain the epistemic function of these images in early modern science. Stalnaker argued that conditional excluded middle should be included in the principles that govern counterfactuals on the basis that intuitions support that principle. This is because there are pairs of competing counterfactuals that appear to be equally acceptable. In doing so, he was forced to introduced semantic vagueness into his system of counterfactuals. In this paper it is argued that there is a simpler and purely epistemic explanation of these cases that avoids the need for introducing semantic vagueness into the (...) semantics for counterfactuals.
